ARTICLE 1: APPLICATION AND MODIFICATION OF THE CONDITIONS OF SALE |

These general terms and conditions apply to all orders placed on our site www.frenchfavors.com. The company reserves the right to adapt or change at any time these general conditions of sale. All modifications will be applied to each order according to the conditions in force at the date of the order. |

ARTICLE 2: AVAILABILITY AND PRODUCT DETAILS |

Our products and prices are valid as long as they are visible on the site, within the limits of available stocks.
Upon receipt of your order, we check the availability of the product (s) ordered. If unavailable, we are committed within 15 days from the validation of the order to deliver the product or offer a similar product at a similar price or reimburse you.
We are not held responsible in the event of delay due to disruption to the supplier's stock. Furthermore, we are not held responsible for non-substantial differences between the presentation of photos of items on our site, texts and illustrations and the items ordered.
The date of validation of the order is:
• The date of the order if paid by credit card or Paypal online
• The date of receipt of settlement in case of payment by check, money order or bank transfer |

ARTICLE 3: VALIDATION OF ORDERS AND ELECTRONIC SIGNATURE (LAW OF 13 MARCH 2000 ON ELECTRONIC SIGNATURE) |

Any order signed by the consumer by the "double click" is an irrevocable acceptance that can not be challenged within the limits set out in these general conditions of sale.
The "double click" associated with the procedure for authentication and non-repudiation and protection of the integrity of messages is an electronic signature. This electronic signature has the same value between the parties as a handwritten signature.
For any purchase with a view to export, you should check the specific laws of the country concerned, whether for taxes, declarations, prohibitions, etc.
We are not held responsible for non-compliance with the legislation of the country where the product is the delivered.
It is your responsibility to check with local authorities for the possibility of importing or using products or services.
3.1 Information required when ordering:
You must verify the completeness and compliance of the information that you provide to us when ordering, particularly concerning the delivery address.
We are not held responsible for possible errors and consequences arising from it (for example delays or errors in deliveries). In this context, the costs incurred for the return of the order are yours. |

ARTICLE 4: PRICES |
 |
Despite all our efforts, it is possible that a small number of items amongst the hundreds of items on our site contain a price error. Rest assured, however, that we conduct the price audit during the process of sending your article. If the price is lower than the fixed price on our site, we will apply the lowest price and send your article. If the price is higher than the fixed price posted on our site, we will notify you and proceed with the cancellation of your order unless you choose to accept the order at the new price.
French Favors reserves the right to change its prices at any time but undertakes to apply the prices that were displayed at your order. |

ARTICLE 5: METHOD OF PAYMENT |

5.1 – Terms of Payment (credit card and Paypal) :
Payment occurs on the secure servers of our banking partner. This means that your banking information is not transferred to French Favors. Payment by credit card is perfectly safe, and your order will be validated and registered upon acceptance of payment by the bank that you have chosen.
Your credit card details are encrypted using SSL (Secure Socket Layer) and are never transmitted clearly on the network. The payment is directly made at the bank. French Favors has no way to access these details, and do not hold it on its servers. That is why you are asked for these details for each new transaction on our site. |

5.2 – French bank check, mandate, bank transfer
Your order is maintained for 15 days. Beyond this period, without receiving your payment, it will be cancelled. The order will be processed only on receipt of your payment and after validation.
The French bank check or mandate is made out to "French Favors" and then sent to the address: French Favors, 16, Rue la Bellone, 34140 Mèze, France.
Please remember to enclose the document that you should have printed once you placed your order with your payment.
The products remain the property of French Favors until full payment of the order to French Favors. Following the receipt of the order by the customer, the risks of goods are transferred to the customer. |

ARTICLE 6: PREPARATION AND DELIVERY |

6.1 – Preparation
French Favors ensures the preparation and packing of all orders. The company uses bubble wrap, tissue paper and new cardboard boxes. The packaged products are verified at the time of packing. |

6.2 – Shipping
• Deliveries by Colissimo via the French postal service for FRANCE.
• Deliveries by Colissimo International via French postal service for abroad.
Any contested Colissimo delivery will not give rise to compensation from the post office. Therefore, no claim for non receipt of a direct Colissimo will be accepted by our services beyond 25 days after shipment. |

6.3 – Customs
Any order placed on our sites and delivered outside France may be subject to taxes and customs duties which are imposed when the package reaches its destination. These tariffs and taxes related to the possible delivery of an article are at your expense and are your responsibility. We are not required to verify and inform you of customs duties and taxes apply. If you want to know, we advise you to ask the competent authorities of your country. |

6.4 – Delivery
• Colissimo: average time announced by the Post Office for France: 48-72 hours. |

ARTICLE 7: RESPONSIBILITIES |
 |
French Favors may use the customer email for sending information on the status of the order.
The customer is responsible for the address provided and French Favors cannot be held responsible for the non-receipt of these emails.
French Favors cannot be held responsible for the breach of contract, due to the occurrence of an event of external forces and particularly in the event of total or partial strike of postal services, transport or natural disasters caused by floods or fires. As regards the products purchased to meet business needs, French Favors will not be liable for any damages as a result of this, operating loss, loss of profits, damages or expenses that may arise.
The selection and purchase of a product or service are placed under the sole responsibility of the customer. The total or partial inability to use the products will not give rise to any compensation or reimbursement nor will the responsibility of French Favors be invoked, except in the case of a defect found, non-compliance, defect or for exercising the right of withdrawal.
The products are delivered to the shipping address you provided during the ordering process. If the address is incomplete or erroneous, charges to return the products remain the responsibility of the customer.
It is necessary to verify the status of products upon delivery in the presence of the delivery man/woman (in case of breakage, see Article 8.4). If a customer accepts a package, it will not be possible to return it to the post office in the future. French Favors is not responsible for breakage caused during shipment.
If a package is delivered damaged, the Post Office should be contacted for all claims. |

ARTICLE 8: TREATMENT OF RETURNED PACKAGES |

8.1 – Returns on the grounds “not at this address”
General
The packages are returned by the provider responsible for delivery under the words: Not at this address.
Processing a return on the grounds “not at this address”
Following receipt and acceptance of your package by our services, depending on the nature of the product, we suggest that we resend the product initially ordered at your expense. Upon request, proof (photocopy of the Colissimo label) may be transmitted to get a refund of shipping by mail.
Otherwise, a refund (excluding postage and packing) will be credited to your account within 48 hours after receipt of your package. |

8.2 – Returns on the grounds "unclaimed"
General
These are packages that have not been claimed by customers at the post office in a timely manner.
Processing a return on the grounds "unclaimed"
Following receipt and acceptance of your package by our services, depending on the nature of the product, we will suggest resending the product initially ordered at your expense.
Otherwise, a refund (excluding postage and packing) will be credited to your account within 48 hours after receipt of your package. |

8.3 – Returns on the grounds "refused"
General
You refused the package.

Following receipt and acceptance of your package by our services, a refund (excluding postage and packing) will be credited to your account within 48 hours after receipt of your package. |

8.4 – Returns on the grounds "damaged"
General
These are packages that were not delivered or were rejected by the customer because of damaged packaging.
Processing a return on the grounds "damaged"
If the package is damaged, you must refuse the package and contact our services so that we know.
Following receipt and acceptance of your package by our services, depending on the nature of the product, availability of stocks and according to your wishes, we will suggest resending the product initially ordered or an alternative product with equivalent characteristics.
Otherwise, a refund (excluding postage and packing) will be credited to your account within 48 hours after receipt of your package. |

ARTICLE 9: RIGHT OF RETURN |
 |
9.1 – Procedure and general conditions of return
With the aim of identifying and therefore processing returns in an optimal manner, any product that must be returned requires a return authorization from our services. The time allotted to you to contact your customer service depends on the reason for return. The request for return authorization must be made through our customer service via the contact form on the website (http://www.frenchfavors.com/contact-us/contact-form.html)
Upon receipt of the authorization you have 7 days to return the product. After this deadline, your return will be refused. We advise you to make a return by Colissimo. Otherwise, if the package shipped is not returned to us, you will not be able to launch a postal service search in order to ask them to locate it. Please note that any package not shipped by our care is not under our responsibility. Only the sender of the parcel is able to launch a postal service search.
Note: On receipt, our services will verify the compliance of the product returned and the reason for return. If the product is not returned compliant, it will be rejected by our services and will be returned at your expense. If your return is not in good faith, your product may be refused and therefore may be returned at your expense. The reason for return may be reclassified. Therefore, you will be informed by e-mail and processing of your return will be based on the new grounds. |

9.2 – Returns for error of reference
Terms of return
You have 72 hours to report that the product received was not the product ordered: error reference, a problem of size, colour, features, or a completely different product.
The product must be returned in good condition. After this deadline, no returns will be accepted.
Processing your return for errors of reference
Following receipt and acceptance of your package by our services, depending on the nature of the product, stocks available and according to your wishes, we will suggest returning the product initially ordered or exchanging it for a product with the equivalent characteristics.
Otherwise, a purchase order will be credited to your account within 48 hours after receipt of your package.
Return costs
After approving and accepting your package, if the charges incurred at the Post Office are known by our services, we will proceed to a reimbursement of these expenses. An invoice will be requested by our customer service so that the latter is able to generate the corresponding purchase order.
Note: The amount of these charges will be based on the general public tariffs in force, provided by the Post Office for Colissimo Suivi. The maximum amount may not exceed 7.40 €. |

9.3 – Return for withdrawal
Terms of return
In accordance with article L.121-20-2 of the Consumer Code, you have a period of 7 days from the date of delivery of your order, to return any item that does not suit you, in its original packaging and in good condition. A refund (excluding postage and packing) will be credited to your account within 48 hours after receipt of your package. It corresponds to the amount of products (excluding postage). You therefore have 7 days to notify us that you wish to retract.
ATTENTION: No withdrawal will be accepted if the product is not returned in its original packaging.
Therefore, the product must be returned in perfect condition, unopened, not unsealed, undamaged, unmarked.
Otherwise, the product will be returned at your expense.
Specific conditions for exercising the right of withdrawal on certain product categories mean the following can not be returned:
• Food (coated almond, coated chocolate, all other confectionery)
• Customised items (personalized label, printed ribbon, printed napkins)
Charges return for withdrawal
The cost of return in case of withdrawal remains the responsibility of the customer. |
